Announcement
The Office for the Solicitation and Selection of the Theme Songs for Beijing 2008 Olympic Games announces that partial changes will be made in the "SOLICITATION AND SELECTION OF THE THEME SONGS FOR BEIJING 2008 OLYMPIC GAMES, Rules for the Year 2003" (hereunder the "Rules") due to some rearrangements in the process of solicitation and selection of the theme songs.
The details of the changes are as follows:
I. In the "Application Scope" of the "Rules", "The Olympic Songs Solicitation of 2003 will begin from April 15, 2003 and end on August 31, 2003" is changed to "The Olympic Songs Solicitation of 2003 will begin from April 15, 2003 and end on October 15, 2003."
II. In the "Selection of the Participating Songs" of the "Rules", "1. Schedule of Selection The selection of Participating Songs will begin from September 1, 2003 and end on November 30, 2003. The result of the selection will be announced in December 2003" are changed to "1.Schedule of Selection The selection of Participating Songs will begin from October 16, 2003 to December 15, 2003. The result of the selection will be announced by the end of December 2003."
III. In the "Schedule of the Campaign" of the "Rules", "April 15, 2003 ~ August 31, 2003: Submission of the Participating Songs. August 31, 2003: Deadline for submission of the Participating Songs.September 1, 2003 ~ November 30, 2003: The selection of the Participating Songs.December 2003: The Olympic Song Solicitation Office announces the final result of the 2003 selection" are changed to "April 15, 2003 ~ October 15, 2003: Submission of the Participating Songs.October 15, 2003: Deadline for submission of the Participating Songs.

SOLICITATION AND SELECTION OF THE THEME SONGS
FOR BEIJING 2008 OLYMPIC GAMES
Rules for the Year 2003
Beijing Organizing Committee for the Games of the XXIX Olympiad ("BOCOG") hereby announces that, BOCOG plans to launch the Solicitation and Selection of Theme Songs for Beijing 2008 Olympic Games (the "Olympic Songs Solicitation" or the "Campaign") to solicit theme songs for the 2008 Olympic Games. The Olympic Songs Solicitation will be organized and supervised by the Office for the Solicitation and Selection of Theme Songs for Beijing 2008 Olympic Games (the "Olympic Songs Solicitation Office").
The Olympic Songs Solicitation will begin from April 15th, 2003 and end on December 31st, 2007.The objective of this Campaign is to spread the Olympic spirit of "Citius, Altius, Fortius", to promote the theme of "Green Olympics, Hi-Tech Olympics and People's Olympics" and to carry forward the cultural background and humanism of China.Under the Olympic Songs Solicitation, ten "Songs for the Beijing 2008 Olympic Games" (the "Selected Songs") will be selected every year and be widely promoted.The official theme song for the opening ceremony of the 2008 Olympic Games will be chosen from the Selected Songs.
The Olympic Songs Solicitation Office invites all people and entities, who are willing to abide by the following rules (the "Rules") and who are enthusiastic about the Olympic Movement and concern about the Beijing 2008 Olympic Games, to participate in the Olympic Songs Solicitation for the year of 2003, with an aim to express to the world the true meaning of "New Beijing, Great Olympics" and the harmonious co-existence and mutual development of China's modernization and its traditional culture and civilization.
I. Application Scope of the Rules
The Olympic Songs Solicitation of 2003 will begin from April 15th , 2003 and end on OctoberAugust 3115st, 2003 (the "Campaign Period"). The Rules apply to all candidate songs delivered to the Olympic Songs Solicitation Office within the Campaign Period. In case the song is presented by courier, the presenting date shall be the time when the song is delivered to the Olympic Songs Solicitation Office; in case the song is presented by mail, the presenting date shall be the arrival time to Beijing as indicated by the postmark. Rules for campaigns of the subsequent years will be noticed separately.
II. Participants
Any individual (natural person) and/or company, enterprise, organization, institution or other entities ("Entity") from any country (region), who is enthusiastic about the Olympic Movement and who concerns about and supports the 2008 Olympic Games, is welcome to participate in this Campaign and to present, according to this Rules, to the Olympic Songs Solicitation Office the songs created independently and/or jointly (the "Participating Song"). The above individuals and Entities include lyrists, composers, performers who perform and record the Participating Songs for the purposes of this Campaign and other participants (collectively called the "Participants").
III. Participating Method
1. Presentation of the Participating Songs
The Participating Songs shall be presented in both the following manners:
(a) One copy of audio media of the Participating Song (in the format of diskette, CD, CD-R, MD or DAT); and
(b) Eleven copies of the opera of the Participating Song, among which, nine copies shall not indicate the name of the composer or the lyrist. The opera of the song refers to the combination of the music score and the lyric. The music score should be presented in either numbered musical notation or staff. The lyric should be written beneath the corresponding note without restriction on the language.
2. Other Documents to be Presented
Participants shall present the following documents in company with the Participating Songs:
(a) One copy of the Participant's brief resume (including the description of previous awards, if any) in either Chinese or English;
(b) One photocopy of the identification document of each Participant;
(c) The Participation Form (original) filled out and signed in accordance with this Rules in either Chinese or English; and
(d) The Entrustment Agreement (original) signed in either Chinese or English in accordance with this Rules.
Any Participating Song without any document as required in the above Clause 2 (a), 2(b), 2(c) or 2(d) presented by the ending date of this Campaign will not be qualified for participation.
3. Address for Presentation

4. Obtaining the Participation Form and the Entrustment Agreement
Participants may obtain a copy of this Rules, the Participation Form and the Entrustment Agreement through one of the following channels:
(a) Downloading from the official website of BOCOG (www.beijing-olympic.org.cn) or the website of Beijing Music Radio (FM974.tom.com);
(b) Requesting from Beijing Music Radio at the Youjiu Music Store, No. 14 Jianguomenwai Avenue, Beijing; or
(c) Obtaining through other channels authorized by the Olympic Songs Solicitation Office.
Photocopies of the blank Participation Form and the Entrustment Agreement are valid.
5. Instructions on Filling (Signing) the Participation Form
The Participant should provide his/her/its identification information and the contents of the songs in the Participation Form and should sign in the same name or title as that appears on the identification document.
If when the Participant composes (or has partly contributed to the composition) more than one Participating Song, the Participant should fill out and sign one Participation Form for each of the Participation Songs that are created or partly contributed by him/her/it. If/when a Participating Song is a joint product, each contributing Participant should fill out and sign a Participation Form for such Participating Song.
If/when any Participant refuses to fill out (or sign) the Participation Form for a Participating Song or fills out (or sign) the Participation Form in an inaccurate and/or incomplete manner, the relevant Participating Song will lose its qualification for the participation.
6. Signing the Entrustment Agreement
All the Participating Songs are composed under the entrustment of BOCOG. Each Participant should sign the Entrustment Agreement for his/her/its Participating Song.
If/when the Participant composes (or has partly contributed to the composition) more than one Participating Song, the Participant should fill out and sign one Entrustment Agreement for each of the Participation Songs that are composed or partly contributed by him/her/it. If/when a Participating Song is a joint product, each contributing Participant should fill out and sign one Entrustment Agreement for such Participating Song.
If/when any Participant refuses to fill out (or sign) the Entrustment Agreement for a Participating Song or fills out (or sign) the Entrustment Agreement in an inaccurate and/or incomplete manner, the relevant participating song will lose its qualification for the participation.
Information about the Participant provided in the Participation Form and the Entrustment Agreement of the same Participating Song should be consistent with each other. Any inconsistency between such information will render the relevant Participating Song unqualified for the participation.
The entrusted matter under the Entrustment Agreement is restricted to the composition of the Participating Song. BOCOG does not, in the Entrustment Agreement, entrust the Participant to conduct any other activity in the name of BOCOG with any third party. In case the Participant acts beyond the authorization of the Entrustment Agreement, such activity will cause the Entrustment Agreement invalid and the relevant Participating Song unqualified for the participation.
7. Other Requirements for the Documents
The Participant shall have the necessary capacity for civil rights and capacity for civil conducts to fill out and sign all the documents stipulated in this Rules and to perform the entrusted matter.
The Participating Song of any person without capacity for civil conduct or any person with restricted capacity for civil conduct will not be qualified for the participation, unless his/her statutory agent expressly agrees on the participation and signs all the documents stipulated in this Rules.
The Participants shall clearly fill out (or sign) in black or blue carbon ink all the documents as stipulated in Clause 2(a), 2(b), 2(c) and 2(d) of this Rules.
8. Identification Documents
The Participant shall submit one of the following documents, which should be legitimate and valid, to identify his legal status:
(a) For natural persons: Identification Card, Household Registration Book, Passport or other official documents with equal authority;
(b) For Entities: Registration documents or other official documents with equal authority.
The Participant shall present one photocopy of each of the aforesaid identification documents. The Olympic Songs Solicitation Office has the right to verify the authenticity and accuracy of such photocopies.
IV. Requirements for the Participating Composition
1. Requirements for the Participating Composition
(a) The Participating Song should be original product by the Participant, which has never been published in any form or publicly performed in any form, and has not entered into the public domain;
(b) The Participating Song should fully reflect the Olympic spirit;
(c) The Participating Song should reflect the unique cultural background and humanism of Beijing and China;
(d) The Participating Song should reflect the theme of "New Beijing, Great Olympics";
(e) The Participating Song should reflect the concept of "Green Olympics, Hi-Tech Olympics and People's Olympics";
(f) The Participating Song should reflect the characteristics of the times, has high artistic standard and is easy to be accepted and learned by the public;
(g) The Participating Song, without restriction on language or style, should be melodious in music and in lyrics.
IV. Requirements for the Participating Composition
(a) The Participating Song shall not be the same as, or similar to, the national anthem of the People's Republic of China or any other nation;
(b) The Participating Song shall be apparently distinct from the official Olympic Anthem, the theme songs of any of the previous Olympic Games or any other major worldwide sport events;
(c) The Participating Song shall not contain any contents in violation of the Constitution or any law and/or regulation of the People's Republic of China;
(d) The Participating Song and all the materials applied in the Participating Song shall not infringe on the copyright, trademark or other intellectual property rights or proprietary rights of any third party, or infringe on any other rights of any third party;
(e) The Participating Song shall not contain any contents allegedly expressing ethical discrimination or religious discrimination, threatening the relationship among countries, or otherwise in conflict with the public interest and common custom of any country.
Failure to satisfy any of the above conditions will cause the Entrustment Agreement invalid and the relevant Participating Song unqualified for the participation.
V. Disposal of the Participating Songs and Relevant Documents and Copyright Ownership
All Participating Songs and relevant documents submitted to the Olympic Songs Solicitation Office, including audio media, opera, the Participation Forms, the Entrustment Agreements and identification documents, will not be returned to the Participants.
The Participant shall agree that, in accordance with the provisions of the Entrustment Agreement, the copyright of the Participating Songs shall belong to BOCOG ever from the very beginning. BOCOG has the right, at its own discretion, to determine the venue, the manner and the performer (singer) to use the Participating Songs without interference or restriction from the relevant Participant.
VI. Selection of the Participating Songs
1. Schedule of Selection
The selection of Participating Songs will begin from SeptemberOctober 116, 2003 and end on November 30to December 15, 2003. The result of the selection will be announcedpublicized byin the end of December 2003.
2. Selection Method
The selection will be conducted in three phases: the Preliminary Selection, the Interim Selection and the Final Selection. The following methods will be used in different phases:
(a) A panel of five members will participate in the Preliminary Selection to select, by voting, forty Participating Songs for the Interim Selection;
(b) A panel of seven members will participate in the Interim Selection to select, by grading, twenty Participating Songs with the highest scores for the Final Selection;
(c) A panel of seven or nine members will participate in the Final Selection to select, by grading, ten Participating Songs with the highest scores as the Selected Songs for the year of 2003.
The panel for each selection phase will be appointed or recruited by the Olympic Songs Solicitation Office. To ensure the justice and confidentiality of the selection process, a Chinese notarization agency will be invited to notarize the entire selection process, including the Preliminary Selection, the Interim Selection and the Final Selection. The names of the panel members will be publicized simultaneously with the list of the Participants for the Selected Songs.
3. Prize
Each Selected Song will be awarded with a certificate an a prize of RMB 5,000 Yuan. The amount is pre-tax. The Participant for the relevant Selected Song shall pay taxes for such prize according to the law of relevant countries (including but not limited to the People's Republic of China) and regions.
The Selected Songs will be preformed in the "2003 Concert of Beijing 2008 Olympic Songs". The Participants who compose and/or perform the Selected Songs will be invited to the concert.
VII. Schedule of the Campaign
April 15, 2003: The Olympic Song Solicitation Office publicizes the Rules, the Participation Form and the Entrustment Agreement. The Campaign begins.
April 15, 2003 ~ October 15August 31, 2003: Participating Songs are presented.Submission of the Participating Songs.
October 15August 31, 2003: Deadline for presentingsubmission of the Participating Songs.
October 16September 1, 2003 ~ December 15November 30, 2003: The selection of the Participating Songs.
End of December 2003: The Olympic Song Solicitation Office announces the final result of the 2003 selection and publicizes the names of all the panel members.
VIII. Inquiry, Notification and Consultation
The information about the Campaign and its progress and the information about the qualified Participating Songs submitted and the relevant Participants can be obtained through the following channels:

The information about the Participants and the Participating Songs will be publicized on the aforesaid websites within fifteen working days after the qualified Participating Songs be sent to the Olympic Songs Solicitation Office. In case the Participating Song is presented by courier, the presenting date shall be the time when the song is delivered to the Olympic Songs Solicitation Office; in case the participating Song is presented by mail, the presenting date shall be the arrival time to Beijing as indicated by the postmark.

IX. Miscellaneous Items
In the event of any discrepancy between the Rules and any documents related to the Campaign issued prior to the publication of the Rules, the Rules shall prevail.
The Rules, the Participation Form and the Entrustment Agreement are published in both Chinese and English. In the event of any discrepancy between the Chinese version and English version, the Chinese version shall prevail.
In the event of any ambiguity on the meaning of the Rules, the Participation Form or the Entrustment Agreement, BOCOG reserves the right of final interpretation. Issues not addressed in such documents shall be subject to additional rules to be formulated by BOCOG and the interpretation thereof by BOCOG.
